The team

The Markets Group manages the end-to-end process for regulating markets including supervision, triage, investigation and enforcement.

Markets Enforcement is responsible for taking enforcement action (including disruptive action) on matters such as continuous disclosure, insider trading, market manipulation, licensing obligations and misconduct by Retail OTC issuers.

Markets Enforcement investigates suspected market misconduct and takes formal enforcement action in response to suspected breaches of the Corporations Act and Market Integrity Rules. This includes commencing civil proceedings, working with the Commonwealth Department of Public Prosecutions (CDPP) to secure criminal convictions and taking administrative action through the Market Disciplinary Panel.

The role

As an Investigator, you will:

  • project manage and contribute to the investigation of suspected misconduct in areas that ASIC regulates.
  • conduct investigative tasks including the analysis of large electronic data sets using specific software, drafting/serving compulsory notices, collecting and reviewing documents.
  • interview and obtain information from a range of witnesses.
  • identify legal issues and provide legal advice in the course of an investigation, including advice as to evidence required to prove contraventions, admissibility of evidence and the use of ASIC's statutory powers.
  • compile briefs of evidence for the CDPP and assist the CDPP to prepare for and conduct criminal prosecutions.
  • support ASIC Litigation Counsel in commencing and conducting civil litigation in the Supreme and/ or Federal Courts, including briefing and instructing Counsel.
  • compile administrative briefs to ASIC delegates.

About you

  • A relevant tertiary qualification.
  • Investigative and analytical skills with experience planning and managing complex investigations and projects through to conclusion.
  • Skills in analysing and interrogating large complex data and evidence, and drive to understand the issues and take appropriate action.
  • Experience effectively presenting complex information to different target audiences through strong business writing and verbal communication skills.
  • Experience building and maintaining relationships with senior internal and external stakeholders and professional networks.
  • Demonstrated capacity to use a variety of digital applications for investigative, research and data collation purposes.
  • Experience applying the Corporations Act, ASIC Act and other relevant legislation is desirable.
